Terms of Service

1. Who we are

Birchwood Tales ("we," "us," or "our") operates the Birchwood Tales story library at stories.birchwoodtales.com (the "Service"). The Service gives subscribers access to a library of original audio bedtime stories designed for children. By creating an account or using the Service, you agree to these Terms of Service.

2. Eligibility

You must be at least 18 years old to create an account and subscribe. The Service is intended for use by parents and guardians on behalf of children in their care. By registering, you confirm that you are an adult and that you are responsible for any use of the Service by minors in your household.

3. Your account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. One subscription covers your household — you may use the same account across multiple devices. Please don't share your login with people outside your household. If you believe your account has been compromised, contact us at support@birchwoodtales.com.

4. Subscription and billing

Access to the full story library requires a paid subscription at $7.99 per month. Your subscription renews automatically each month until you cancel.

• Billing is processed securely through Stripe. We never store your card details.
• Your subscription begins the day you complete checkout and renews on that same date each month.
• We will send you a reminder email 30 days before each renewal, including the renewal date, the amount that will be charged, and instructions for how to cancel.
• You can cancel at any time from your Account page — the same way you signed up, online. Your access continues until the end of your current billing period and you won't be charged again after that.
• If we change the subscription price, we will notify you at least 30 days in advance by email before the new price takes effect.

5. Refunds

Subscription charges are generally non-refundable. If you believe you were charged in error, contact us within 14 days at support@birchwoodtales.com and we'll work it out. We handle refund requests on a case-by-case basis and will always try to do right by you.

6. Content and intellectual property

All stories, audio recordings, artwork, and other content in the Birchwood Tales library are owned by Birchwood Tales and protected by copyright. Your subscription gives you a personal, non-transferable license to stream content for private, non-commercial use within your household.

You may not download, copy, redistribute, or reproduce any content from the Service. You may not use our content for commercial purposes or create derivative works from it.

7. Children's privacy

Our stories are designed for children, but accounts are created and managed by parents or guardians. We do not knowingly collect personal information from children under 18. We collect only the information needed to manage your account and subscription (name, email address, and payment records via Stripe). We do not sell your information to third parties.

8. Acceptable use

You agree not to:

• Share your account credentials publicly or sell access to your subscription
• Attempt to download, scrape, or cache audio content from the Service
• Use the Service in any way that could damage, disable, or impair it
• Attempt to access any part of the Service you are not authorized to use

9. Service availability

We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may occasionally take the Service offline for maintenance or updates. We are not liable for any inconvenience caused by temporary downtime. New stories are added regularly but we make no guarantee of a specific release schedule.

10. Disclaimer and limitation of liability

We work hard to keep the Service running well, but we cannot guarantee it will always be error-free or available without interruption. To the extent permitted by applicable law, Birchwood Tales is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

Our total liability to you for any claim arising from use of the Service will not exceed the amount you paid us in the 3 months prior to the claim.

11. Physical product

Tommy the Bear and any other physical Birchwood Tales products are sold separately through our Shopify store at birchwoodtales.com and are subject to separate purchase terms, including shipping, returns, and warranty policies listed there. These Terms of Service apply only to the digital story library subscription. If you have questions about a physical product order, please contact us at support@birchwoodtales.com.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll let you know by email or by posting a notice on the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles. Any disputes arising under these Terms that are not resolved informally will be subject to the jurisdiction of the courts located in Utah. Nothing in this section limits any rights you may have under applicable consumer protection laws in your state of residence.
